In September 2018 The Supreme Court of India gave judgment by upholding the Constitutional Validity of Aadhaar. Are now there is one more change coming soon in Aadhaar where the Aadhaar Holder may be able to withdraw their Aadhaar Number but only in one condition if he doesn’t have PAN Card.
The mandatory condition of linking PAN with Aadhaar would remain unchanged. But residents above 18 Years if wishes could withdraw their Aadhaar.
So by these new changes in Aadhaar, the holders would get the liberty to withdraw their Aadhaar Number anytime as they need. The Government of India is currently working on this new proposal and it would be finalized very soon and the changes would be soon reflected in the Aadhaar Act.
According to the sources, this new move by UIDAI and Government of India would give the residents the option to opt-out of Aadhaar which would include withdrawing of demographic and biometric details from the UIDAI database.
However, this new proposal seeks to allow residents above 18 Years of age to be provided six months of the timeline to decide whether they want to withdraw their Aadhaar Number or not. But here there is one condition, which is not every resident would be given choice to opt-out of Aadhaar. This new proposal will only allow residents to opt-out of Aadhaar who do not have a PAN Card or do need none in the future. However, the PAN Card Holders still need to link their PAN with Aadhaar as mandated by the Supreme Court of India.
This Proposal was meant to be made available for a small group but the Law Ministry has recommended that it should be made available to all citizens.
The Supreme Court if India in the month of September had given a historic judgment which upheld the validity of Aadhaar. The Court also added that Aadhaar is playing a major role in serving the benefits to marginalized sections of the society and also it is giving them an identity. The Supreme Court if India mandated Aadhaar for various purposes like for availing Government Subsidies, Filing ITR, Applying for PAN Etc. In the same month, the Court also stated that it is no more mandatory to link Aadhaar with Bank or Mobile Number and no children would be denied for any Government Schemes if they don’t possess Aadhaar. The Court also suspended part of the Aadhaar Act which allowed to store Authentication Records for 5 Years and changed it to six months.
